SMS Terms and Conditions
Internal emergency voicemail notification program
Effective date: October 12, 2026
These SMS Terms and Conditions govern participation in the Engel & Associates, LLC Emergency Voicemail Alerts operated by Engel & Associates, LLC. The Program sends designated employees an SMS notification when an emergency voicemail has been received. It is limited to specific employees using company-provided mobile phones.
1. Program description
After enrollment, a designated employee may receive an operational alert indicating that an emergency voicemail has been received. Depending on the capabilities and configuration of the Company’s communications system, the alert may contain only a notification that a voicemail was received, or it may also include limited information such as the caller’s telephone number, the time of the call, or all or part of a voicemail transcription. The Program is not a marketing or promotional message program.
2. Eligibility and enrollment
Participation is limited to employees selected by the Company for the emergency-notification role. Before messages begin, each designated employee must affirmatively consent to receive Program messages at the assigned company-provided mobile number. The employee may opt out by replying STOP and must notify the Managing Member so that another approved recipient or notification method can be arranged.
3. Sender identification
Messages are sent by or on behalf of Engel & Associates, LLC from 208-578-7905. The initial message will identify the Company or Program so the employee can recognize the sender and purpose.
4. Message frequency and charges
Message frequency varies based on the number of emergency voicemails received. Message and data rates may apply. Delivery may be delayed or unsuccessful because of carrier, network, device, filtering, outage, or other conditions outside the Company’s control.
5. Opt out
Reply STOP to stop future Program messages. A confirmation message may be sent after the request. Because the Program supports an emergency business process, an employee who opts out must promptly notify Managing Member so the Company can arrange another approved recipient or notification method.

7. Recipient responsibilities
- Keep the company-provided phone reasonably secure and comply with applicable company security and acceptable-use requirements.
- Promptly report a lost, replaced, reassigned, or compromised device or telephone number.
- Use alerts and related voicemail information only for authorized business purposes.
- Do not forward alerts or disclose voicemail information to unauthorized persons.
- Do not send confidential or sensitive information by SMS unless the Company has expressly approved that method.
- Do not rely on the Program as a substitute for calling emergency services or using another required emergency channel.
8. Privacy
Program information is handled according to the Company’s SMS Privacy Policy, available at engelassociates.com/sms-privacy-policy. Mobile information is not sold or shared with third parties or affiliates for their marketing or promotional purposes. SMS opt-in data and consent records are not shared with third parties for marketing.
9. Program availability
The Company may modify, suspend, or discontinue the Program when operational, security, legal, carrier, or service-provider requirements change. The Company does not guarantee uninterrupted, timely, or error-free message delivery.
10. Changes to these terms
The Company may revise these Terms and Conditions. The effective date shown above identifies the current version. Material changes will be communicated through an appropriate company channel. If renewed consent is legally or operationally required, the Company will request it before continuing messages.
11. Relationship to company policies and law
These terms supplement applicable company policies and employee acknowledgments. They do not waive rights or obligations that cannot lawfully be waived. If these terms conflict with applicable law or a controlling written company policy, the applicable law or controlling policy governs.
